Welcome to EscrowWays
These Terms of Service (or "Terms") are the legal agreement between you and EscrowWays. They cover how you can use our platform, what we promise to you, and what you promise to us. By using EscrowWays.com, creating an account, or buying or selling on the platform, you agree to these Terms.
We've written these Terms in plain English so you can actually understand what you're agreeing to. We've also separated specific topics into their own pages — when this document references "our Privacy Policy" or "our Acceptable Use Policy," those pages are part of this agreement.
Quick summary
EscrowWays is Pakistan's escrow-protected marketplace for digital goods and services. We hold payments safely until buyers confirm receipt, charge sellers a 2% commission on completed sales, follow Pakistani law, protect your data, and resolve disputes fairly within 48 hours. Who we are
EscrowWays operates from Pakistan and provides an online marketplace where Pakistani buyers and sellers transact digital goods and services with built-in escrow protection. The website is operated through escrowways.com and any associated subdomains, apps, and services.
When this document says "EscrowWays," "we," "us," or "our," it refers to the EscrowWays platform and the team operating it. When it says "you" or "your," it refers to anyone who uses, browses, or registers on the platform.
The agreements that make up our Terms
These Terms of Service are the umbrella legal agreement. Specific topics have their own detailed pages, which are all part of this agreement. Make sure you've read each one that applies to you:
- Acceptable Use Policy — rules for what you can do, what you can sell, and how to behave
- Buyer Agreement — your specific rights and responsibilities as a buyer
- Seller Agreement — your specific rights and responsibilities as a seller (required reading if you sell)
- Privacy Policy — how we collect, use, share, and protect your personal data
- Cookie Policy — how we use cookies and tracking technologies
- KYC and AML Policy — identity verification and anti-money-laundering procedures
- Chargeback Policy — why and how we handle chargebacks and the no-chargeback rule
- Refund and Dispute Policy — how refunds work and how disputes are resolved
If anything in these specialized policies conflicts with this Terms of Service, the more specific policy applies for that topic. For example, the Refund and Dispute Policy is more specific on refund timing than these Terms.
Eligibility — who can use EscrowWays
To use EscrowWays, you must:
- Be at least 18 years old
- Have the legal capacity to enter into a contract under Pakistani law
- Provide accurate, current, and complete information when creating an account
- Not be a person or entity barred from using our services under any applicable law
- Not be located in or representing a country subject to international sanctions
- Comply with all applicable laws in your jurisdiction
If you don't meet these requirements, you cannot use EscrowWays. If you create an account using false information or fail to meet eligibility, we may close your account and forfeit any funds in the wallet related to fraudulent activity.
Your account
Creating an account
To use most features, you need an account. When you create one:
- Use your real name and accurate contact details
- Choose a strong, unique password
- Verify your email and mobile number
- Enable two-factor authentication (strongly recommended; required for sellers)
Keeping your account secure
You're responsible for everything that happens through your account. To protect yourself:
- Don't share your password or 2FA codes with anyone, ever
- Use a unique password not used on other websites
- Log out when using shared or public devices
- Notify us immediately at abuse@escrowways.com if you suspect unauthorized access
EscrowWays is not responsible for losses resulting from your failure to protect your account credentials. If your account is compromised because of your security mistakes, you're responsible for any resulting losses.
One account per person
You may have one EscrowWays account. Creating multiple accounts to manipulate ratings, bypass restrictions, evade suspensions, or otherwise game the platform is prohibited and results in all accounts being banned.
Account verification
For certain activities (high-value transactions, selling, large withdrawals), we require you to verify your identity through our KYC process. See our KYC and AML Policy for full details on when verification is required and what documents we accept.
How EscrowWays works
Our role
EscrowWays is a marketplace platform that facilitates transactions between buyers and sellers. We are not the seller of items listed on the platform — sellers are individual users or businesses who list their own products. We provide:
- The marketplace where listings are displayed
- The payment processing infrastructure (escrow)
- The dispute resolution system
- Identity verification and trust signals
- Customer support for platform-related issues
Sellers are responsible for their listings, delivery of products, accuracy of descriptions, and customer service related to specific orders.
Escrow protection
When a buyer places an order, payment is held in escrow by EscrowWays rather than transferred directly to the seller. The seller receives payment only when:
- The buyer confirms receipt of the product
- The auto-release window (typically 24 hours) passes without a dispute
- A dispute is resolved in the seller's favor
This protects buyers from non-delivery and sellers from fraud. See our Buyer Agreement and Seller Agreement for the full mechanics.
Commission
EscrowWays charges sellers a 2% commission on the gross value of each completed transaction. Buyers don't pay any platform fee directly. The commission is automatically deducted when funds are released to the seller.
Acceptable use
By using EscrowWays, you agree NOT to:
- Violate any applicable law, regulation, or third-party right
- Use the platform for fraud, money laundering, or terrorist financing
- List or sell prohibited items (see our Acceptable Use Policy for the full list)
- Provide false information during registration, KYC, or transactions
- Impersonate another person, business, or entity
- Bypass our payment, dispute, or messaging systems
- Use bots, scripts, or automated tools to interact with the platform without our written permission
- Attempt to access parts of the platform you're not authorized to access
- Reverse engineer, decompile, or attempt to extract source code from the platform
- Use the platform to harass, threaten, or harm others
- Distribute malware, viruses, or anything intended to disrupt the platform
- Engage in any activity that interferes with or disrupts the platform's normal operation
- Scrape, copy, or extract content from the platform for unauthorized purposes
- Coordinate with others to manipulate ratings, prices, or disputes

Content you provide
Your content
You retain ownership of content you post on EscrowWays (listings, photos, descriptions, messages, reviews). However, by posting content, you grant EscrowWays a non-exclusive, worldwide, royalty-free license to use, display, distribute, and modify that content as necessary to operate the platform, including:
- Displaying your listings to other users
- Showing your reviews and ratings on seller profiles
- Including your listings in search results and recommendation algorithms
- Featuring listings in marketing materials about EscrowWays
- Storing and backing up your content on our systems
This license ends when you remove the content from the platform, except for backups and legal records we're required to keep.
Your warranties about your content
When you post content, you confirm that:
- You own or have permission to post it
- It doesn't infringe anyone else's copyrights, trademarks, or other rights
- It's accurate and not misleading
- It doesn't violate any law
- It doesn't contain malware, viruses, or harmful code
Our right to remove content
We may remove any content that violates our policies, breaks the law, or is reported as inappropriate. We try to be fair, but we don't have to give you notice before removing content if it's clearly violating our rules.
EscrowWays intellectual property
The EscrowWays platform — including the website design, code, logos, branding, software, and content we create — is owned by EscrowWays and protected by intellectual property laws. You may not:
- Copy, modify, or distribute our platform's code or design
- Use our logos, name, or branding without written permission
- Create derivative works based on our platform
- Remove copyright notices from any part of the platform
- Use the EscrowWays name or branding to mislead anyone about your affiliation with us
Limited license to use the platform: as long as you comply with these Terms, we grant you a personal, non-transferable, revocable license to access and use EscrowWays for its intended purpose (buying and selling).
Fees and payments
What we charge
- Sellers: 2% commission on completed transactions
- Buyers: no platform fees; you pay only the listed price and any seller-stated extras
- Withdrawals up to PKR 50,000/month: free
- Withdrawals above PKR 50,000/month: small processing fee, disclosed before withdrawal
Payment processing
We process payments through licensed Pakistani payment providers (JazzCash, EasyPaisa, SadaPay, PayFast, and commercial banks). Their processing fees may apply to certain transactions and are typically disclosed at checkout.
Currency
All transactions are processed in Pakistani Rupees (PKR). For listings in other currencies, the PKR equivalent at the time of purchase is what's charged.
Taxes
You're responsible for paying any taxes that apply to your activity on EscrowWays. We don't automatically deduct income tax from seller earnings. Sellers should report their earnings to FBR as taxable income.
Disputes and refunds
When something goes wrong with a transaction, our internal dispute system is the primary way to resolve it. Detailed procedures are in our Refund and Dispute Policy, but key points:
- Buyers have 24 hours from delivery to open a dispute
- Disputes are resolved within 48 hours by our admin team
- Possible outcomes: full refund, partial refund, or release to seller
- Both parties have appeal rights for 48 hours after the original decision
- Senior admin reviews are final on the platform
You agree to use our dispute system before contacting your bank or filing a chargeback. Filing an unauthorized chargeback violates our Chargeback Policy and may result in account suspension.
Suspension and termination
If you want to leave
You can close your account at any time from your settings page. Pending orders must be resolved first. Your wallet balance is returned to you (minus any amounts owed from disputes). Some data is retained for legal reasons even after closure — see our Privacy Policy.
If we suspend or terminate your account
We may suspend or terminate your account if you:
- Violate these Terms or any of our specific policies
- Provide false information during registration or KYC
- Engage in fraud, scams, or other illegal activity
- Repeatedly violate platform rules even after warnings
- File unauthorized chargebacks
- Are confirmed to be on a sanctions list
- Fail to respond to our reasonable requests for information
- Use the platform in ways that harm other users or our business
What happens when we terminate
- You're notified by email with the reason
- Pending orders are resolved fairly (refunds where you were wronged, releases to other parties where they did their part)
- Your remaining wallet balance is returned, minus amounts owed
- You may not create a new account on EscrowWays
- For serious violations, we may share information with law enforcement and payment partners
You can appeal a suspension or termination by emailing support@escrowways.com within 7 days. We review every appeal personally.
What EscrowWays promises (and doesn't)
What we promise
- To hold escrow funds safely and release them only as the rules describe
- To verify sellers through our KYC process before they can list
- To process disputes fairly and within stated timeframes
- To protect your data per our Privacy Policy
- To follow Pakistani law and applicable regulations
- To maintain reasonable security on our systems
- To communicate honestly about platform changes
- To work with payment partners to coordinate on fraud
What we don't guarantee
EscrowWays is provided "as is" and "as available." We do our best, but we don't guarantee:
- That the platform will always be available without interruption
- That every listing is genuine or accurately described — sellers are responsible for their listings
- The intrinsic quality of products sold by individual sellers (we mediate disputes, we don't guarantee subjective quality)
- That third-party services we depend on (payment processors, hosting, email) will work perfectly at all times
- Specific commercial outcomes for sellers (sales volume, profit, growth)
- That listings from a specific seller are still valid (services like Netflix may suspend transferred accounts; this is a known risk we disclose)
Limitation of liability
To the extent permitted by Pakistani law, EscrowWays' total liability to you for any claim is limited to the amount you paid us in fees in the 12 months before the claim arose, or PKR 10,000, whichever is greater.
We are not liable for:
- Indirect, incidental, consequential, or special damages
- Lost profits, lost data, or business interruption
- Damages resulting from acts beyond our reasonable control (natural disasters, power outages, internet provider failures, government actions, war, pandemics)
- Damages resulting from your failure to secure your account
- Damages resulting from the actions of other users (sellers, buyers) — we mediate disputes but don't guarantee outcomes
- Damages from third-party services we integrate with (payment processors, identity verification services, etc.)
These limitations apply even if we knew the damages were possible. They don't apply where the law prohibits limiting liability.
Indemnification
You agree to defend, indemnify, and hold harmless EscrowWays and its team from any claims, losses, damages, costs, and expenses (including reasonable legal fees) arising from:
- Your violation of these Terms
- Your violation of any law or third-party right
- Your content posted on the platform
- Your transactions with other users
- Misuse of the platform by anyone using your account
This means if someone sues us because of something you did, you cover our costs. This is standard for online platforms.
Force majeure
EscrowWays isn't liable for failures or delays in performance caused by events beyond our reasonable control. Examples include:
- Natural disasters (earthquakes, floods, fires)
- Government actions or regulations
- War, terrorism, civil unrest
- Pandemics and public health emergencies
- Internet outages, power failures, or telecommunications disruptions
- Cyberattacks targeting infrastructure beyond our control
- Strikes or labor disputes affecting our suppliers
If a force majeure event prevents us from running the platform, we'll do our best to restore service and protect user funds, but we're not financially liable for the disruption.
Dispute resolution and governing law
Governing law
These Terms and any disputes arising from them are governed by the laws of Pakistan, without regard to conflict-of-law principles.
Where disputes are heard
Any legal dispute between you and EscrowWays will be heard exclusively in the courts of Pakistan, in the jurisdiction where EscrowWays is registered. You consent to the personal jurisdiction of these courts.
Try internal resolution first
Before filing any legal action, you agree to first contact us at support@escrowways.com and give us 30 days to try to resolve the issue through good-faith communication. Most disagreements can be resolved without litigation.
Class action waiver
To the extent permitted by law, you agree to resolve disputes individually rather than through class actions or representative proceedings.
Changes to these Terms
We may update these Terms as our platform evolves, as we add features, or as laws change. When we update:
- Material changes are announced at least 14 days before taking effect
- Registered users get an email notification
- We post a notice on the platform
- Continued use of the platform after the change date means you accept the new version
- If you disagree with material changes, you can close your account before they take effect
For non-material changes (typo fixes, clarifications), we may update the document without prior notice. The date at the top of this page tells you when it was last updated.
Other important provisions
Entire agreement
These Terms, together with the specific policies they reference (Privacy Policy, Acceptable Use Policy, etc.), are the entire agreement between you and EscrowWays. They replace any prior agreements or understandings.
Severability
If any part of these Terms is found to be unenforceable, the rest of the Terms remain in full effect. We may modify the unenforceable part to make it enforceable while preserving its original intent.
No waiver
If we don't enforce a particular provision of these Terms in one situation, that doesn't mean we waive our right to enforce it later or in other situations.
Assignment
You may not transfer your rights or obligations under these Terms to anyone else without our written permission. We may transfer our rights and obligations (for example, in a business acquisition or restructuring) without your consent, though we'll notify you if material changes result.
Headings
The headings in these Terms are for convenience only and don't affect interpretation.
Language
These Terms are in English. If we provide translations into Urdu or other languages, those translations are for convenience only. The English version is the authoritative version in case of any conflict.

What is the Terms of Service?

Do I have to read all the linked policies too?
Yes, ideally. The Acceptable Use Policy, Privacy Policy, Buyer Agreement, Seller Agreement, Chargeback Policy, Refund and Dispute Policy, KYC and AML Policy, and Cookie Policy are all part of this agreement. The Terms of Service is the umbrella; those policies are the specifics.
What law governs my use of EscrowWays?
Pakistani law governs your use of the platform. Disputes between you and EscrowWays are heard in Pakistani courts. This applies whether you're located in Pakistan or elsewhere.
Can EscrowWays close my account anytime?
We can close your account for serious violations of these Terms (fraud, repeated rule-breaking, illegal activity). We try to give warnings for minor issues first. You can also close your own account anytime from your settings.
What happens to my data if I close my account?
Most data is deleted within 12 months of closure. Some data (KYC documents, financial records) is retained for 5 years under Pakistani anti-money-laundering law. Full details are in our Privacy Policy.
Does EscrowWays guarantee that listings are accurate?
Sellers are responsible for the accuracy of their own listings. We verify their identity through KYC, but we don't independently verify each product. If something is misrepresented, our dispute system gives you a way to get refunded.
What if I'm not in Pakistan but I want to use EscrowWays?
You can use the platform if your country isn't subject to international sanctions. Payment methods may be limited depending on what gateways serve your country. You're still subject to Pakistani law as the governing jurisdiction of these Terms.
Can I file a chargeback with my bank if I have a problem?
No, you've agreed not to. Our dispute system is faster and fairer than a bank chargeback. Filing an unauthorized chargeback violates our Chargeback Policy and may result in account suspension.
What happens if these Terms change?
You'll be notified at least 14 days before material changes take effect. If you keep using the platform after the change date, you've accepted the new version. If you disagree, you can close your account first.
Does EscrowWays take responsibility if a seller scams me?
Our role is to mediate, not insure. We hold payments in escrow until you confirm delivery, we run a fair dispute system, and we ban confirmed scammers. But we're not liable for individual seller misconduct beyond what's covered by our dispute process.
What is "limitation of liability"?
It's a legal way of saying that if something goes wrong with the platform itself (not a specific transaction), our maximum financial responsibility is limited. This is standard for online platforms and protects us from unreasonable claims. It doesn't affect your rights under our dispute system or applicable consumer protection laws.
What does "force majeure" mean?
It's a legal term for events beyond our reasonable control — natural disasters, government actions, internet outages, etc. If a force majeure event disrupts the platform, we're not liable for the disruption itself, but we'll do our best to restore service and protect your funds.
What if there's a conflict between these Terms and a specific policy?
The more specific policy applies for that topic. For example, the Refund and Dispute Policy is more detailed on refund mechanics than these Terms, so those details govern. The Terms cover everything that isn't addressed in a specific policy.
Can I print or save these Terms?
Yes. We encourage you to save a copy of these Terms (and the specific policies they reference) for your records. The date at the top tells you which version you saved.
Where can I see previous versions of these Terms?
Previous versions are archived. Email legal@escrowways.com if you need a specific historical version (for example, the version that was in effect on a specific date when you transacted).
